Minors’ and Parents’ Rights
Wholeness Health LLC follows Colorado and federal law regarding the privacy rights of minors and the rights of parents or legal guardians to access a minor’s PHI.
Access by Parents or Legal Guardians
In most cases, parents or legal guardians may access the PHI of their minor child, including medical and mental health information.
Exceptions Under Colorado Law
Colorado law allows minors to consent to certain types of care on their own. When a minor legally consents to their own treatment, the minor generally controls who may access their records. We will not share this information with a parent or guardian unless:
- The minor provides written authorization; or
- Disclosure is otherwise required by law.
These exceptions include:
- Outpatient mental health services: Minors aged 12 and older may seek outpatient psychotherapy or counseling without parental consent. These records are confidential unless the minor authorizes disclosure (C.R.S. §12-245-203.5). Minors aged 15 and older may seek mental health services without parental consent. These records are confidential unless the minor authorizes disclosure (C.R.S. §27-65-104).
- Emergency situations: Information may be disclosed when necessary to prevent serious and imminent threats to the health or safety of the minor or others.
- Mandatory reporting: Information may be disclosed as required by law, including reporting suspected child abuse or neglect.
When a Minor Objects to Parental Access
If a minor is legally permitted to consent to their own care and does not wish for a parent or guardian to access their PHI, we will follow state and federal law in determining whether disclosure is permitted or prohibited.
When Parents Have Full Access
If a minor is not legally permitted to consent to the care they are receiving, or if a parent or guardian provided consent for the treatment, then the parent or guardian generally has the right to access the minor’s PHI, unless a specific legal exception applies.
